Legionella. The duty-holder must first identify and assess the risk in the actual hot- and cold-water system. All systems require a suitable assessment, but not every system requires an elaborate control programme. If the assessment concludes that there is no reasonably foreseeable or significant risk and existing controls are adequate, no additional scheme may be needed beyond maintaining and reviewing those controls. Where a risk is identified that cannot be prevented, the duty-holder must appoint competent responsibility and implement a proportionate written control scheme, monitoring and records. The five-employee threshold concerns recording significant findings; it does not create or remove the underlying duty. Records of the risk assessment, responsible persons, written control scheme and its implementation should be retained while they remain current and for at least two years afterwards; monitoring, inspection, test and check results should be retained for at least five years. HSE record-keeping guidance. Where temperature is chosen as the control method, hot water should be stored at 60°C or above; monitored hot-water outlets should reach at least 50°C within one minute; and monitored cold-water outlets should be below 20°C after running for two minutes. Grease and commercial kitchens. Approved Document H paragraph 2.21 gives a BS EN 1825 grease separator or another effective means of grease removal as the standard compliance approach for drainage serving commercial hot-food kitchens. This is not an automatic requirement for one named device in every existing premises, and the chosen arrangement must be accessible for emptying and maintenance. Any enforcement depends on the actual legal route and circumstances: a local authority may use Building Act 1984 section 59 powers to require unsatisfactory drainage to be improved; unlawful sewer discharges can be enforced or prosecuted under Water Industry Act 1991 section 111; and an emergency prohibition order under section 12 of the Food Safety Act 1990 depends on an imminent risk of injury to health, not merely the absence of a particular separator. Commercial gas. Gas work in domestic properties and workplaces such as shops, restaurants, schools and hospitals must be carried out by a Gas Safe registered engineer whose ID card covers the relevant commercial appliance and work categories.
